K1 Visa Eligibility - Fiance Visa Requirements

These are the specific Fiance Visa requirements so that a foreign fiance(e) may come to the U.S. for the purpose of marriage.

Petitioner Should Meet These Requirements:

You must be a U.S. citizen.
You intend to marry the beneficiary within 90 days upon their entry into the U.S.
You have met the beneficiary in person within 2 years prior to filing the petition.
- If you have not met due to foreign cultural beliefs or extreme hardship, it must be properly explained.
You are free to marry.
- You must be of legal age to marry.
- You are currently unmarried.
- All previous marriages must have legally ended through divorce, annulment or death.
You must disclose any criminal records.
- Some crimes are grounds for denial.
You must comply with the International Marriage Broker Regulation Act (IMBRA).
- if introduced through an international marriage broker

Beneficiary Should Meet These Requirements:

You intend to marry the petitioner within 90 days after entering the U.S.
You are free to marry.
- You must be of legal age to marry.
- You are currently unmarried.
- All previous marriages must have legally ended through divorce, annulment or death.
You must disclose any criminal records.
- You must have never been deported from the U.S.
- You must have never committed any crimes of moral turpitude.
- You must have never engaged in acts of terrorism or have been a member of a designated terrorist organization.
You must pass a medical exam.
- You must not have certain untreated communicable diseases.
- You must not be a user of prohibited drugs.
