A diagram of how your fiance(e) can come to the U.S. and stay with you permanently using a K1 Visa. Get an understanding of what actions you need to take, how long it might take and how much you can expect to spend.
The overall view of the Fiance(e) Visa process is depicted here:
1. It starts from the U.S. citizen who submits an I-129F to petition the foreign fiance(e). Thus, he/she is called the petitioner and is responsible for submitting the petition package to the Unites States Citizenship and Immigration Services (USCIS).
2. Once the USCIS approves the petition, it is forwarded to the National Visa Center (NVC).
3. The NVC conducts their own review of the petition. They assign a visa case number and transfer everything to the U.S. Embassy closest to the foreign fiance(e) (beneficiary).
4. The fiance(e) in the foreign country then applies for the visa, takes the medical exam and goes to the Consulate for the visa interview.
5. The K1 Visa is released a few days after the successful interview. The visa holder has six (6) months to enter the U.S. Once in the U.S., the beneficiary marries the American fiance(e) within 90 days.
6. After the marriage, the beneficiary files for adjustment of status to become a permanent resident and receives a two-year Conditional Green Card.
7. Three months just before the Conditional Green Card expires, the beneficiary applies to have the conditions removed and receives a 10-year Green Card as a Legal Permanent Resident (LPR).
